OFFICIAL GIVEAWAY RULES & REGULATIONS

IMPORTANT: Please read these Official Rules before entering the Gift Card Giveaway (the “Sweepstakes”), presented by The Giants 100 (“Sponsor”). By entering the Sweepstakes, you agree to the terms of these Official Rules. These Official Rules shall govern in the event of any inconsistency with other Sweepstakes-related materials.

NO PURCHASE NECESSARY TO ENTER OR WIN.

ELIGIBILITY: The Sweepstakes is open to residents of the fifty (50) United States and the District of Columbia, who are 18 years of age or older at time of entry. All federal, state, and local regulations apply. LIMIT ONE ENTRY PER PERSON. VOID WHERE PROHIBITED OR RESTRICTED. Employees of Sponsor its parents, subsidiaries, affiliates, suppliers, and agencies, and their immediate family members and persons living in their household are not eligible to enter the Sweepstakes.

In the event of a dispute, entries will be deemed made by the authorized account holder of the email address or social media account used for entry. Automated entries are prohibited, and any use of automated devices will result in disqualification. Sponsor is not responsible for incorrect or inaccurate entry of information by entrants; lost or late entries or transmissions; interrupted or unavailable network, server, or other connections; scrambled transmissions or other errors or problems of any kind whether mechanical, human, or electronic, technical malfunctions of any computer hardware, software, or any combinations thereof; or problems associated with any virus or any other damage caused to entrants’ systems. Incomplete or illegible entries will be voided. All entries become the property of Sponsor and will not be returned. If for any reason the Sweepstakes is not capable of being conducted as described in these rules, which includes a Sweepstakes minimum requirement of one thousand entries, Sponsor shall have the right to cancel, terminate, modify or suspend the Sweepstakes.

PRIVACY POLICY: All information submitted in connection with entry to this Sweepstakes shall be governed by Sponsor’s privacy policy (at https://www.thegiants100.com). By entering this Sweepstakes, you acknowledge that you have read and agree to this privacy policy.

No transfer or cash or other substitution of all or part of a prize is permitted, except by Sponsor, which reserves the right, in its sole discretion, to substitute the prize or prize component with another of comparable or greater value. Any and all taxes on the prize will be the responsibility of the winners. Sponsor shall not be responsible for any delays, damage in the delivery of the prize, and/or loss of any prize in connection with delivery of the prize via mail. In the event that there is an insufficient number of eligible entries, Sponsor reserves the right not to award the prizes.

TAMPERING DISCLAIMER: The Sponsor, in its sole discretion, reserves the right to disqualify and  prohibit from participating any person, who the Sponsor determines (in its discretion) is or is attempting to: (i) tamper with any part of the Contest; (ii) attempting to undermine the legitimate operation of the  Contest by cheating, deception, or other unfair playing practices, (iii) intending to annoy, abuse, threaten  or harass any other participants, agents or representatives of the Sponsor; and/or (iv) otherwise violating  these Official Rules.

PUBLICITY; USE OF PERSONAL INFORMATION: By participating, winner grants permission to  the Sponsor to use their name, character, photograph, voice, and likeness in connection with the promotion of this and other contests and waives any claims to royalty, right, or remuneration for such use. By participating in the Contest, where allowed by law, participants agree that the Sponsor may use such information for marketing purposes and may include the name of the winner in a publicly available winner(s) list.

RELEASE: By participating in the Contest, each participant and winner holds harmless and waives any and all claims of liability or damages against the Contest's Sponsor and their respective employees and agents, for any personal injury or any loss which may occur from the conduct of, or participation in, the  Contest, or from the award, receipt and/or use or misuse of any prize, including any travel related thereto.

MISCELLANEOUS: Sponsor reserves the right to remove anyone from the sweepstakes we deem to be using fake profiles, bots, paid profiles or social media groups to gain an edge in the sweepstakes will disqualify you.

COMPLIANCE WITH LAW: BY ENTERING THE CONTEST, PARTICIPANTS HEREBY SUBMIT TO THE JURISDICTION AND VENUE OF THE FEDERAL AND STATE COURTS OF NEW JERSEY AND WAIVE THE RIGHT TO HAVE DISPUTES ARISING OUT OF THIS CONTEST ADJUDICATED IN ANY OTHER FORUM. IN NO EVENT WILL PARTICIPANT BE ENTITLED TO INJUNCTIVE OR EQUITABLE RELIEF OF ANY KIND, OR RESTRAIIN THE CONTINUATION OF ANY CONTEST. 

LIMITATION OF LIABILITY: By entering you agree to release and hold harmless The Giants 100 and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant's participation in the sweepstakes and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error which may occur in the administration of the Promotion or the processing of entries.

RULES MAY BE AMENDED AT ANY TIME IN SPONSOR'S SOLE DISCRETION.

WINNER SELECTION:

ONE (1) Grand Prize Winner will be selected in a random drawing on or about October 20, 2024, from all eligible entries received by the entry deadline. The odds of winning depend on how many eligible entries have been received. Winners will be notified via email or social media and must respond to the notification within ten (10) days of receipt. Winners may also be required to complete, execute and return an Affidavit of Eligibility and Release. Noncompliance with these conditions may result in forfeiture of the Prize, and Sponsor reserves the right to select alternate winners (in random drawing from other eligible entries received before the deadline) in such circumstance or to cancel the Prize in its totality. If Winner notification of the Prize is returned as undeliverable, Sponsor may, at its discretion, select an alternate winner.

DISCLAIMERS: By competing in this Sweepstakes and/or accepting the prize, entrants agree that Sponsor, and its respective parent companies, assigns, subsidiaries and affiliates, and advertising, promotion and fulfillment agencies and all of their respective employees, officers and directors will have no liability whatsoever, and will be held harmless by entrants for any liability for any injuries, losses, or damages of any kind to person and property resulting in whole or in part, directly or indirectly, from the acceptance, possession, misuse, or use of the prizes, or participation in this Sweepstakes. By accepting a prize, each Winner consents to the use of his/her name for publicity and promotional purposes on behalf of Sponsor with no additional compensation or further permission (except where prohibited by law). Any dispute arising from this Sweepstakes will be determined according to the laws of the State of New Jersey, without reference to its conflict of law principles, and by entering the entrants consent to the personal jurisdiction of the state and federal courts located in New Jersey and agree that such courts have exclusive jurisdiction over all such disputes.
